Let Me See If I Understand This

Inmates at Guantanamo have rights and can have their day in court but those in the bases in Afghanistan cannot? WTF is the difference? I thought many inmates at Guantanamo have even come from this base in Afghanistan. I even agree with Obama on his support of Bush on this one, but I then ask why is is not the same for GITMO. I need an explanation please.
